This document is an electronic record under the Information Technology Act, 2000 and the rules made under it, and the provisions on electronic records in the various statutes as amended by that Act. It is generated by a computer system and does not require a physical or digital signature.

It is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which requires the publication of the rules and regulations, privacy policy and terms of use governing access to or usage of the domain name https://www.pranabsviewfinder.com (the "Website"), together with the client portal operated under it — referred to collectively in these terms as the Platform.

These terms govern your use of this website and the client portal, and the basis on which Pranab's Viewfinder ("the Studio") provides photography and event-related services. Please read them alongside the Privacy Policy and the Refund and Cancellation Policy, which form part of them.

Pranab's Viewfinder is a sole proprietorship carrying on business in India. The proprietor, the registered place of business and the contact details are published in the identity block at the foot of this page, and that is the party you contract with.

By using this website or sending an enquiry you accept these terms. If you go on to book the Studio, your signed agreement and the accepted quotation govern that engagement, and these terms fill any gap they leave.

1. What this website is

This website is the Studio's portfolio and its enquiry channel. Nothing is bought on this page: there is no basket, no price is charged here, and submitting the enquiry form does not reserve a date or create a contract.

Prices shown on this website are indicative starting points for planning purposes. The price for your event is the one stated in a quotation issued to you.

The Studio provides a service, not a product. It sells no physical goods through this website, operates no shipping or courier service, charges no shipping fee, and dispatches nothing to an address. There is accordingly no shipping policy, and no returns or exchanges policy, because there is nothing to ship or return. Where an album or a print is expressly included in your package it is produced as part of the commissioned service and handed over as described in clause 8.

2. Your information and your account

You agree to give the Studio true, accurate and complete information when you enquire, when you register for the client portal, and afterwards. A wrong email address is the usual reason a quotation, an agreement link or a gallery does not arrive.

If you hold a client portal account you are responsible for what is done through it, so keep your password to yourself and tell the Studio promptly if you believe someone else has it. The Studio may suspend an account it reasonably believes is being misused.

The Studio may decline or discontinue portal access where an account was created with details that are not yours.

3. Enquiry, quotation and how long a quotation lasts

An enquiry leads to a conversation and then, if you wish, to a quotation setting out the package, deliverables, add-ons, price and applicable tax. A quotation is sent to you as a private link and is also available in your client portal.

Every quotation states its own expiry, shown on it as 'Valid until'. That date is set for your quotation individually — it is not a fixed period applying to all quotations, and this policy deliberately does not state one.

A quotation may be accepted at any time up to the date shown on it. After that date it can no longer be accepted, its pricing and the Studio's availability may need to be reconfirmed, and the Studio may issue a fresh quotation on revised terms.

Accepting a quotation is not the booking. It is your agreement to the scope and the price, and it is what the agreement in clause 4 is then drawn up from.

4. The agreement and how it is signed

Once a quotation is accepted the Studio issues an agreement for the engagement. You sign it electronically, using a one-time code sent to the email address on your record. Signing that way is a valid execution of the agreement and you agree not to dispute its validity on the ground that it was signed electronically.

An agreement carries its own signing deadline and lapses if it is not signed by then. One live agreement exists per booking; if one expires or is voided before signature, a replacement may be issued, and the date is not held in the meantime.

Where the signed agreement and these terms disagree, the signed agreement prevails for that engagement.

5. Confirming the booking, and what is payable when

The Studio invoices against the signed agreement. A booking advance of 20% of the total agreement amount confirms the booking, and your date is reserved once that payment is confirmed. The advance is not refundable — see the Refund and Cancellation Policy, which sets out the position in full.

The balance of 80% is due no later than one day before the event date.

The Studio is not obliged to attend an event for which the balance has not been received, and full payment is required before the finished photographs, videos or other final assets are handed over.

Add-ons and extras agreed after signing are invoiced separately and are payable on the terms stated on that invoice.

6. Invoices, due dates and paying online

Every invoice states its own due date, shown on it as 'Due date'. Payment is expected by that date. An invoice's due date is set for that invoice individually and is independent of the expiry of any quotation — the two are separate dates set for separate purposes, and neither implies the other.

Invoices are visible in your client portal, and each carries a secure payment link so that it can also be paid without signing in. You can pay in full or in part, so an advance and a balance can be paid against the same invoice.

Payments are handled by the Studio's payment gateway, not by the Studio. You enter your card or UPI details on the gateway's own secure page; the Studio never sees, handles or stores your full card number, CVV, UPI PIN or net-banking password. A payment is treated as received when the gateway confirms it, and a receipt is issued for each payment received.

The Studio also accepts bank transfer and other direct means where you prefer them. A payment made that way is treated as received when it clears, and is recorded against your invoice by the Studio.

All prices are quoted and payable in Indian Rupees (INR). Goods and Services Tax, where it applies, is shown separately on the quotation and the invoice at the rate in force.

Online payment depends on the gateway being available. If it is unavailable, the payment option may be withdrawn temporarily and the Studio will tell you how else to pay.

7. The event date, and what the Studio needs from you

The event date, coverage hours and locations are those stated in your quotation and agreement. Changes to them are a rescheduling, governed by the Refund and Cancellation Policy.

You agree to obtain permission from the venue for photography, including any fee, permit or restriction the venue imposes, and to tell the Studio about restrictions in advance.

You agree to provide reasonable and safe access, a running order, and a nominated point of contact on the day, so that the Studio can shoot the schedule you are expecting. Where the Studio's crew is prevented from working safely or is obstructed, the Studio may pause coverage and will tell you why.

You agree to cooperate with the photographers and videographers, and to ask your guests and your other suppliers to do the same. The Studio cannot photograph what it is not given access to, and time lost to a schedule that overruns is time lost from the coverage you booked.

You agree to respond within a reasonable time when the Studio asks for selections, approvals or delivery details. Delivery timelines run from the point at which the Studio has what it needs from you.

8. What the Studio delivers

The number of edited photographs, the coverage hours, the crew, any album or print, and the delivery window are those stated in your quotation and agreement. They are not varied by anything on this website.

Where your quotation and agreement do not state a delivery window, the Studio's standard timelines apply: edited photographs are delivered within 60 days, and video or film deliverables within 90 days. Both periods run from the later of the event date and the date on which the Studio has received full payment and any selections or approvals it has asked you for. A period covering more than one event day runs from the last of them. Albums and prints, where included, are produced after your final selections are approved and are handed over within a further 30 days, as they depend on an external press.

If the Studio needs longer than the applicable period — for an unusually large commission, or where a supplier delays a physical item — it will tell you before that period ends and give you a revised date.

Photographs are edited in the Studio's established style, which you can see throughout this portfolio. Editing is part of the work; re-editing to a materially different style is a separate commission.

Finished work is delivered through a private online gallery, and is released once payment is complete. Physical items, where included, are delivered separately and on their own timeline.

The Studio does not guarantee that any specific moment, person or arrangement will be photographed, and does not undertake to reproduce a particular image from another photographer's work.

10. Third-party services

The Studio relies on third parties to take payments, send email and messages, host this site and store files. They are listed in the Privacy Policy. Where you deal with one of them — most obviously the payment gateway's own page — that dealing is governed by their terms and their privacy policy as well as these terms.

This website may link to other websites for convenience. The Studio does not control them and is not responsible for their content or their policies.

11. Availability of the website and the portal

This website and the client portal are provided as they stand. The Studio does not warrant that they will be uninterrupted or error-free, and may suspend either for maintenance or for reasons beyond its control.

The Studio does not warrant the accuracy, timeliness or completeness of the information on this website for any particular purpose, and you should rely on your quotation and agreement rather than on this site for the terms of your engagement.

An interruption to the website or the portal does not affect the Studio's obligation to photograph an event it has contracted to photograph.

12. Prohibited use

You agree not to use this website, the client portal or the Studio's services for any purpose that is unlawful or forbidden by these terms, and not to submit false details, impersonate anyone, attempt to gain access to another client's records, interfere with the site's operation, or scrape it by automated means.

You agree not to attempt to circumvent the payment process, and not to initiate a payment you are not authorised to make.

13. Limits on liability, and indemnity

The Studio carries out its work with reasonable skill and care and backs up files as a matter of routine. Even so, equipment can fail and files can be lost.

Where the Studio is liable to you for any reason connected with an engagement, its total liability is limited to the total amount you have paid for that engagement. The Studio is not liable for indirect or consequential losses, or for loss of profit or opportunity.

You agree to indemnify the Studio against any claim, demand or penalty brought by a third party arising from your breach of these terms, your breach of any law, or your infringement of a third party's rights.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

14. Events beyond either party's control

Neither party is in breach for a failure caused by something genuinely outside its control — including serious illness, accident, natural disaster, severe weather, civil disturbance, government restriction, or the failure of transport or venue access.

The Studio may send a suitably experienced photographer in place of a named individual where illness, injury or an emergency makes that necessary. The deliverables and the standard of work remain as contracted.

Where such an event prevents the Studio from attending, or prevents the event from taking place, the financial consequences are those set out in the Refund and Cancellation Policy.

15. Cancellation, rescheduling and refunds

These are governed in full by the Refund and Cancellation Policy, which forms part of these terms. In summary: the 20% booking advance is not refundable, a cancellation by you does not attract a refund, a cancellation by the Studio refunds everything you have paid, and a rescheduling is free of any cancellation charge where the Studio is available on your new date.

Read that policy before you pay the advance. Where it and this summary disagree, that policy prevails.

16. Changes to these terms

The Studio may update these terms at any time. The version in force for your engagement is the one published when your agreement was signed, and the effective date at the top of this page shows when the current version took effect. It is worth reviewing this page from time to time.

17. Governing law and jurisdiction

These terms, and any dispute or claim relating to them or to their enforceability, are governed by and construed in accordance with the laws of India.

The courts at Purba Bardhaman, West Bengal have exclusive jurisdiction over any dispute arising out of or in connection with these terms.

Before starting proceedings, please raise the matter with the Studio directly using the contact details at the foot of this page. Most disagreements are resolved in a conversation.

18. Contact and grievances

All concerns or communications relating to these terms should be sent to the Studio using the contact details published in the identity block at the foot of this page, which also names the Grievance Officer and the hours during which the Studio is reachable.

The Grievance Officer acknowledges a complaint within 24 hours of receiving it and resolves it within 15 days, as required by the Information Technology (Intermediaries Guidelines) Rules, 2011.
